Terms of Service

These Terms of Service (“Terms”) govern your use of the callq.ai website and the CallQ.AI platform (together, the “Service”), operated by CallQ, a limited liability company (“CallQ.AI”, “we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. SMS and text messaging terms

This section is the messaging program disclosure for our text messaging program. It applies in addition to the rest of these Terms.

Consent to receive text messages is separate, specific and optional. It is not a condition of purchase and is not bundled into acceptance of these Terms or any other agreement. Agreeing to these Terms does not, by itself, opt you in to text messages. You opt in only by taking the separate affirmative action described below.

1.2 How to stop messages

Reply STOP to any message to stop receiving text messages. We also honour STOPALL, UNSUBSCRIBE, CANCEL, QUIT, END, OPTOUT and OPT OUT. You will receive a single confirmation message and then no further messages, unless you opt in again. To resume messages, reply START.

1.4 Privacy of your mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent are excluded from every category of data sharing described in our Privacy Policy. We do not sell, rent or transfer mobile numbers or messaging consent to any third party, lead generator or data broker.

You must be at least 18 years old, or the age of majority where you live, to use the Service. If you create an account you are responsible for the accuracy of your information, for keeping your credentials confidential, and for activity under your account. Notify us promptly of any unauthorised use.

If you use the Service to send communications, you are responsible for obtaining and maintaining valid consent from your recipients, for honouring opt-out requests promptly, and for complying with applicable law including the Telephone Consumer Protection Act and applicable state messaging and do-not-call rules.

4. Fees

Paid plans are billed as described in the applicable order form. Fees are non-refundable unless the applicable order form states otherwise, are exclusive of taxes, and may change on notice for future billing periods. If these Terms conflict with an applicable order form, the order form controls.

5. Intellectual property

We retain all rights in the Service, including software, models, interfaces and trademarks. You retain all rights in the content and data you submit. You grant us a limited licence to host, process and transmit your content solely to provide and support the Service.

6. Third-party services

The Service may interoperate with third-party products. Those products are governed by their own terms, and we are not responsible for their availability, content or practices.

7. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that messages or calls will be delivered without delay or interruption, which can depend on carriers and networks outside our control. AI-generated output may be inaccurate and should be reviewed by a human before it is relied on.

8. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total aggregate liability arising out of or relating to these Terms is limited to the fees paid for the Service in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.

9. Indemnity

You will indemnify and hold us harmless from claims arising out of your use of the Service in breach of these Terms or applicable law, including claims that you sent communications without the required consent.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, if required by a carrier or by law, or to protect the Service or its users. Sections that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms. If a change is material we will update the “Last updated” date and, where required, give notice. Continued use after a change takes effect constitutes acceptance. Changes do not apply retroactively to a dispute already arisen.

12. Governing law and disputes

These Terms are governed by the laws of Arizona, without regard to conflict-of-laws rules. Disputes will be resolved in the state and federal courts located in Maricopa County, Arizona, and you consent to their personal jurisdiction and venue.
